The Advisory Council of JKJAAC Submits Urgent Crisis Charter of Demands to Prime Minister of Pakistan, Calling for De-escalation, Restoration of Dialogue, and Implementation of Muzaffarabad Agreement

Muzaffarabad AJK: The Advisory Council of the Jammu Kashmir Joint Awami Action Committee (JKJAAC) has submitted an Urgent Crisis Charter of Demands to the Prime Minister of Pakistan, Mian Muhammad Shehbaz Sharif, calling for immediate action to prevent further escalation in Azad Jammu & Kashmir and to protect the life, liberty, and security of the people.

The Charter has been submitted in response to the rapidly deteriorating situation in AJK following the non-implementation of the Muzaffarabad Agreement dated 3–4 October 2025, the deployment of paramilitary forces, violent operations against peaceful public mobilisation, the firing incident near Khaigala/Rawalakot, the death of Shazeb Khan, injuries to Sardar Umer Nazir Kashmiri and others, mass arrests, and the notification designating JKJAAC as a proscribed organisation.

JKJAAC reiterates that it is a peaceful civil and political rights movement. Its struggle is for the implementation of agreed commitments, protection of fundamental rights, democratic equality, public dignity, lawful constitutional reform, and restoration of public confidence. JKJAAC does not seek violence, disorder, or any extra-constitutional action.

The Charter calls for an immediate end to the use of force against peaceful protesters, mourners, JKJAAC workers, civil society members, and ordinary citizens. It demands that the funeral prayer of Shazeb Khan be allowed to proceed peacefully and respectfully, and that Sardar Umer Nazir Kashmiri and all injured persons be provided safe, unconditional, and non-custodial medical treatment.

JKJAAC has also demanded written guarantees for the life, liberty, dignity, and physical security of its Core Committee members, negotiators, and recognised civil rights leaders. The committee further calls for the immediate release of all arrested JKJAAC members, workers, supporters, volunteers, transporters, civil society participants, and political detainees arrested in connection with peaceful protests and public mobilisation.

JKJAAC strongly demands the immediate withdrawal of the AJK Government Home Department notification dated 05 June 2026, designating JKJAAC as a proscribed organisation. The committee states that such a measure criminalises peaceful dissent, closes the door to dialogue, and deepens the crisis.

The Charter further calls for the restoration of a formal communication and negotiation channel with designated JKJAAC representatives, with authorised focal persons from both the Federal Government and the AJK Government, written minutes of meetings, time-bound decisions, and protection from arrest or coercion for all participants.

JKJAAC has demanded an independent judicial inquiry into the Khaigala/Rawalakot firing incident, including the death of Shazeb Khan, injuries to others, arrests, and reported disappearances. The inquiry must determine who ordered the operation, which force conducted it, whether live ammunition was used, whether excessive force was applied, and who bears responsibility.

The committee also calls upon the Prime Minister of Pakistan to issue a written reaffirmation that the Government of Pakistan remains guarantor of the Muzaffarabad Agreement and is committed to its full implementation. JKJAAC demands a written implementation matrix covering all accepted points, responsible departments, required notifications or legal instruments, deadlines, budgetary allocations, monitoring authorities, and public reporting mechanisms.

The Charter also calls for urgent constitutional and electoral confidence-building measures, including an emergency session of the AJK Legislative Assembly to address Article 22 and the issue of the 12 non-territorial seats. JKJAAC has demanded revival and completion of the High-Powered Legal and Constitutional Committee process under the Muzaffarabad Agreement.

JKJAAC states that once immediate confidence-building measures are accepted in writing and visibly implemented, the Core Committee will enter immediate dialogue regarding the postponement of the peaceful Long March scheduled for 9 June 2026.

The present crisis must not be treated merely as a law-and-order issue. It is a crisis of trust, representation, implementation, and democratic legitimacy. The use of force will not resolve it; it will deepen it.

JKJAAC remains ready for peaceful, structured, and result-oriented negotiations. However, negotiations cannot take place under fire, arrests, proscription, medical denial, and fear.

جموں کشمیر جوائنٹ عوامی ایکشن کمیٹی (JKJAAC) کی ایڈوائزری کونسل نے وزیراعظم پاکستان میاں محمد شہباز شریف کو بحران سے متعلق فوری مطالبات کا ایک چارٹر پیش کیا ہے، جس میں آزاد جموں و کشمیر میں مزید کشیدگی کو روکنے اور عوام کی جان، آزادی اور سلامتی کے تحفظ کے لیے فوری اقدامات کا مطالبہ کیا گیا ہے۔

یہ چارٹر 3 تا 4 اکتوبر 2025 کے مظفرآباد معاہدے پر عملدرآمد نہ ہونے، نیم فوجی دستوں کی تعیناتی، پُرامن عوامی تحریک کے خلاف پرتشدد کارروائیوں، کھائی گلہ/راولاکوٹ کے قریب فائرنگ کے واقعے، شازیب خان کی ہلاکت، سردار عمر نذیر کشمیری اور دیگر افراد کے زخمی ہونے، بڑے پیمانے پر گرفتاریوں اور JKJAAC کو کالعدم تنظیم قرار دینے کے نوٹیفکیشن کے بعد آزاد جموں و کشمیر میں تیزی سے بگڑتی ہوئی صورتحال کے تناظر میں پیش کیا گیا ہے۔

JKJAAC نے ایک بار پھر واضح کیا ہے کہ یہ ایک پُرامن شہری اور سیاسی حقوق کی تحریک ہے۔ اس کی جدوجہد طے شدہ وعدوں پر عملدرآمد، بنیادی حقوق کے تحفظ، جمہوری مساوات، عوامی وقار، آئینی و قانونی اصلاحات اور عوامی اعتماد کی بحالی کے لیے ہے۔ JKJAAC نہ تو تشدد چاہتی ہے، نہ بدامنی، اور نہ ہی کسی غیر آئینی اقدام کی حامی ہے۔

چارٹر میں پُرامن مظاہرین، سوگواران، JKJAAC کے کارکنان، سول سوسائٹی کے ارکان اور عام شہریوں کے خلاف طاقت کے استعمال کو فوری طور پر بند کرنے کا مطالبہ کیا گیا ہے۔ اس میں مطالبہ کیا گیا ہے کہ شازیب خان کی نماز جنازہ پُرامن اور باوقار انداز میں ادا کرنے کی اجازت دی جائے، جبکہ سردار عمر نذیر کشمیری اور تمام زخمی افراد کو محفوظ، غیر مشروط اور بغیر حراست کے طبی سہولیات فراہم کی جائیں۔

JKJAAC نے اپنے کور کمیٹی کے ارکان، مذاکرات کاروں اور تسلیم شدہ سول رائٹس رہنماؤں کی جان، آزادی، عزت اور جسمانی تحفظ کی تحریری ضمانتوں کا بھی مطالبہ کیا ہے۔ کمیٹی نے مزید مطالبہ کیا ہے کہ پُرامن احتجاج اور عوامی تحریک سے متعلق گرفتار کیے گئے تمام JKJAAC ارکان، کارکنان، حامیوں، رضاکاروں، ٹرانسپورٹرز، سول سوسائٹی کے شرکاء اور سیاسی قیدیوں کو فوری طور پر رہا کیا جائے۔

JKJAAC نے 5 جون 2026 کے آزاد جموں و کشمیر حکومت کے محکمہ داخلہ کے اس نوٹیفکیشن کو فوری طور پر واپس لینے کا بھی پرزور مطالبہ کیا ہے، جس کے ذریعے JKJAAC کو کالعدم تنظیم قرار دیا گیا۔ کمیٹی کا کہنا ہے کہ ایسا اقدام پُرامن اختلافِ رائے کو جرم قرار دیتا ہے، مذاکرات کے دروازے بند کرتا ہے اور بحران کو مزید گہرا کرتا ہے۔

چارٹر میں JKJAAC کے نامزد نمائندوں کے ساتھ باضابطہ رابطے اور مذاکراتی عمل کی بحالی کا مطالبہ بھی کیا گیا ہے، جس میں وفاقی حکومت اور آزاد جموں و کشمیر حکومت کی جانب سے مجاز فوکل پرسنز کی نامزدگی، اجلاسوں کی تحریری کارروائی، وقت مقررہ فیصلے اور تمام شرکاء کو گرفتاری یا دباؤ سے تحفظ فراہم کرنے کی ضمانت شامل ہے۔

JKJAAC نے کھائی گلہ/راولاکوٹ فائرنگ واقعے کی آزاد عدالتی تحقیقات کا مطالبہ بھی کیا ہے، جس میں شازیب خان کی ہلاکت، دیگر افراد کے زخمی ہونے، گرفتاریوں اور مبینہ گمشدگیوں کا جائزہ لیا جائے۔ تحقیقات میں یہ تعین کیا جائے کہ کارروائی کا حکم کس نے دیا، کون سی فورس اس میں ملوث تھی، آیا حقیقی گولیاں استعمال کی گئیں، کیا ضرورت سے زیادہ طاقت استعمال ہوئی، اور اس کی ذمہ داری کس پر عائد ہوتی ہے۔

کمیٹی نے وزیراعظم پاکستان سے یہ مطالبہ بھی کیا ہے کہ وہ تحریری طور پر اس بات کی توثیق کریں کہ حکومت پاکستان مظفرآباد معاہدے کی ضامن ہے اور اس کے مکمل نفاذ کے لیے پُرعزم ہے۔ JKJAAC نے تمام منظور شدہ نکات پر مشتمل ایک تحریری عملدرآمدی فریم ورک کا مطالبہ کیا ہے، جس میں ذمہ دار محکمے، درکار نوٹیفکیشنز یا قانونی اقدامات، مقررہ مدت، مالی وسائل، نگرانی کے ادارے اور عوامی رپورٹنگ کے طریقہ کار شامل ہوں۔

چارٹر میں فوری آئینی اور انتخابی اعتماد سازی کے اقدامات کا مطالبہ بھی کیا گیا ہے، جن میں آزاد جموں و کشمیر قانون ساز اسمبلی کا ہنگامی اجلاس بلانا شامل ہے تاکہ آرٹیکل 22 اور 12 غیر علاقائی نشستوں کے مسئلے پر غور کیا جا سکے۔ JKJAAC نے مظفرآباد معاہدے کے تحت قائم ہائی پاورڈ قانونی و آئینی کمیٹی کے عمل کو بحال اور مکمل کرنے کا بھی مطالبہ کیا ہے۔

JKJAAC کا کہنا ہے کہ جیسے ہی فوری اعتماد سازی کے اقدامات کو تحریری طور پر قبول کر لیا جائے گا اور ان پر واضح طور پر عملدرآمد شروع ہو جائے گا، کور کمیٹی 9 جون 2026 کو طے شدہ پُرامن لانگ مارچ کو مؤخر کرنے کے حوالے سے فوری مذاکرات کے لیے تیار ہو جائے گی۔

بیان میں کہا گیا ہے کہ موجودہ بحران کو محض امن و امان کا مسئلہ نہیں سمجھا جانا چاہیے۔ یہ اعتماد، نمائندگی، وعدوں پر عملدرآمد اور جمہوری جواز کا بحران ہے۔ طاقت کا استعمال اس کا حل نہیں بلکہ اسے مزید سنگین بنائے گا۔

JKJAAC نے کہا ہے کہ وہ پُرامن، منظم اور نتیجہ خیز مذاکرات کے لیے تیار ہے، تاہم مذاکرات فائرنگ، گرفتاریوں، پابندیوں، طبی سہولیات سے محرومی اور خوف کے ماحول میں ممکن نہیں۔

ریاست کی پہلی ذمہ داری جانوں کا تحفظ ہے۔ امن کی جانب پہلا قدم طاقت کا استعمال روکنا ہے۔ اعتماد کی بحالی کا پہلا قدم وعدوں کی پاسداری کرنا ہے۔
